By accessing or using Nexge ('the Service'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms apply to all users, including businesses and individuals who register for a website.
2. Description of Service
Nexge provides professional website design, hosting, and management services for local businesses. Our service includes website creation, bilingual content (English/Spanish), SEO setup, lead capture forms, and ongoing hosting and support. Service availability and features depend on your subscription plan.
3. Subscription and Payment
Nexge offers monthly subscription plans starting at $59/month. All plans require a minimum 3-month commitment. Payments are processed securely through Stripe. Your subscription renews automatically each month unless cancelled. Setup is free — there are no hidden fees beyond the monthly subscription.
4. Cancellation Policy
You may cancel your subscription at any time after completing the minimum 3-month commitment. To cancel, contact us at info@nexge.app at least 7 days before your next billing date. Upon cancellation, your website will remain active until the end of the current billing period.
5. Your Content
You retain ownership of all content you provide to Nexge, including photos, logos, text, and business information. By submitting content, you grant Nexge a license to use it solely for building and maintaining your website. You are responsible for ensuring you have the rights to all content you submit.
6. Acceptable Use
You agree not to use Nexge to promote illegal activities, publish false or misleading information, infringe on intellectual property rights, or engage in any activity that violates applicable laws. Nexge reserves the right to suspend or terminate accounts that violate these terms.
7. Content Moderation
Nexge is exclusively for legitimate local businesses. We do not allow: sexual or obscene content, violence or weapons, political content, illegal substances, discriminatory content, or any content inappropriate for general audiences. We reserve the right to remove content that violates these guidelines without prior notice.
8. Service Availability
We strive to maintain 99.9% uptime for all hosted websites. Scheduled maintenance will be communicated in advance when possible. Nexge is not liable for temporary service interruptions caused by factors outside our reasonable control, including third-party service outages.
9. Limitation of Liability
Nexge's liability is limited to the amount paid for the service in the 3 months preceding any claim. We are not liable for indirect, incidental, or consequential damages. We do not guarantee specific business results, customer acquisition numbers, or search engine rankings.
10. Changes to Terms
We may update these Terms of Service at any time. We will notify you of significant changes by email. Your continued use of the service after changes constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of the State of Virginia, United States. Any disputes shall be resolved in the courts of Virginia.
